TERMS OF SALE

These Terms of Sale govern every purchase made on eversill.com. They sit
alongside our Terms of Service, our Shipping Policy and our Refund and Returns
Policy, which together form the whole agreement between us.

The seller is Vibora Group LLC, a limited liability company registered in the
State of New Mexico, United States, trading as Eversill, with its registered
office at 8206 Louisiana Blvd NE, Ste A #9874, Albuquerque, NM 87113, EIN
98-1953441. In these terms "we" and "the seller" mean Vibora Group LLC, and
"you" means the person placing the order.

1. SCOPE

These terms apply to consumers buying for personal use. We do not sell
wholesale, and we may decline orders that appear to be for resale.

By clicking the payment button you confirm that you have read these terms, that
you are at least 18 years old, and that you are ordering to an address in the
United States.

2. PRODUCT INFORMATION

Each product page states the material, the exact dimensions in inches, and the
size range of animal the product is intended for. Those measurements are the
binding description of what you are buying.

Photographs are representative. Screens render metal finishes differently and a
photograph is not a colour guarantee.

3. HOW A CONTRACT IS FORMED

Placing an order is an offer to buy at the price displayed. The order
confirmation email we send immediately after checkout acknowledges receipt of
that offer, and does not by itself form a contract.

The contract is formed when we send you a dispatch confirmation with a tracking
number. Until that moment we may decline the order in whole or in part, in
particular where the item is out of stock, where the price shown was obviously
wrong, where our fraud screening flags the transaction, or where the delivery
address is outside the United States. If we decline, we refund you in full
within 3 business days and no charge stands.

4. PRICES

Prices are shown in US dollars and are the prices in force at the moment you
place the order. They exclude sales tax.

Sales tax is calculated at checkout on the basis of your delivery address and
is added before payment. Where we have no tax obligation in your state, no tax
is charged.

Any crossed out price shown next to a current price is our own former selling
price for that same item, not an estimate of value or a competitor's price.

5. PAYMENT

We accept the payment methods displayed at checkout. Payment is processed by
Shopify Payments and its underlying processors. We never receive or store your
full card number.

Payment is taken in full at the time of the order. Your order is not processed
until payment is authorized. If a payment is later reversed or charged back
without contacting us first, we may suspend fulfillment while we resolve it,
and we will always try to reach you by email before doing anything else.

6. AVAILABILITY

We list an item as available in good faith on the basis of the stock reported
by our fulfillment center. If an item turns out to be unavailable after you
have paid, we will tell you within 2 business days and give you the choice
between waiting for restock, receiving a different size, or a full and
immediate refund.

7. DELIVERY, RISK AND TITLE

Delivery terms, times and costs are set out in full in our Shipping Policy,
which forms part of these terms. In summary, shipping is free, orders are
dispatched within one business day, and delivery takes 5 to 8 business days
from dispatch within the United States.

Risk of loss and title in the goods pass to you when the carrier delivers the
parcel to the address you gave us. That said, our Shipping Policy commits us to
reship or refund a parcel that is lost or stolen after a delivery scan, which
goes beyond what the law requires of us.

Delivery times are estimates given in good faith. They are not guaranteed
dates, and we are not liable for a delay caused by the carrier, by weather, or
by any other event outside our reasonable control.

8. YOUR RIGHT TO CHANGE YOUR MIND

You have 90 nights from delivery to obtain a full refund of the order,
including shipping, for any reason or for no reason. You do not need to return
the product.

The full conditions, and how to ask, are in our Refund and Returns Policy,
which forms part of these terms. Where anything in these Terms of Sale appears
to conflict with that policy, the Refund and Returns Policy prevails, because
it is the more favourable to you.

9. FAULTY, DAMAGED OR INCORRECT GOODS

If a product arrives damaged, incomplete or in the wrong size, tell us within
30 days of delivery and send a photograph. We will replace it at our cost or
refund you in full, at your choice, and you keep the original item.

This is in addition to, and does not limit, any right you have under the law of
your state.

10. WHAT THE PRODUCT IS, AND IS NOT

The products sold here are household feeding equipment. They are not medical
devices, they are not veterinary treatments, and nothing about them is sold on
the basis that it will diagnose, treat, cure or prevent any condition in any
animal.

We publish no claim that raised feeding prevents gastric dilatation volvulus,
and we do not recommend our products for large or giant deep chested breeds.
Section 6 of our Terms of Service sets this out in full and applies to every
sale.

11. FORCE MAJEURE

Neither party is liable for a failure to perform caused by an event outside its
reasonable control, including natural disaster, fire, epidemic, war, civil
unrest, strike, carrier failure, or the failure of a public utility or
telecommunications network. If such an event prevents us from delivering, we
will refund you in full.

12. LIMITATION OF LIABILITY

Our liability under any single order is limited to the amount you paid for that
order. We are not liable for indirect or consequential loss. Nothing in these
terms limits liability that cannot lawfully be limited, including liability for
death or personal injury caused by our negligence, or for fraud.

13. NO WAIVER, SEVERABILITY

If we do not enforce a term on one occasion, that is not a waiver of it. If a
court finds a term unenforceable, the remaining terms stay in force.

14. GOVERNING LAW

These Terms of Sale are governed by the laws of the State of New Mexico,
without regard to conflict of law rules, and the courts of Bernalillo County,
New Mexico have jurisdiction. This does not deprive you of the protection of
any mandatory consumer law of the state in which you live.

15. QUESTIONS AND COMPLAINTS

Email service.eversill@gmail.com. We answer within one business day. Almost
every problem we have seen is resolved by a refund on the same day, and we
would much rather do that than argue.
